Satzungüber die Erhebung von Friedhofsgebührender Ortsgemeinde Barbelroth vom 05.06.2024
Der Gemeinderat der Ortsgemeinde Barbelroth hat aufgrund der §§ 24 und 26 der Gemeindeordnung für Rheinland-Pfalz (GemO) in der Fassung vom 31.01.1994 (GVBl. S. 153), zuletzt geändert durch Gesetz vom 02.04.1998 (GVBl. S. 108), §§ 1, 2, 7 und 8 des Kommunalabgabengesetzes für Rheinland-Pfalz (KAG) vom 20.05.1995 (GVBl. S. 175) und des § 30 der Friedhofssatzung für die Ortsgemeinde Barbelroth folgende Satzung beschlossen:
§ 1 Allgemeines
Für die Benutzung der Einrichtungen des Friedhofes und ihrer Anlagen werden für Leistungen nach der Friedhofssatzung Benutzungsgebühren erhoben. Die Gebührensätze ergeben sich aus der Anlage zu dieser Satzung als deren Bestandteil. Kosten für besondere Leistungen, die außerhalb dieser Satzung anfallen, werden in tatsächlicher Höhe erhoben. Das Kommunalabgabengesetz findet entsprechende Anwendung.
§ 2 Gebührenschuldner
Gebührenschuldner sind:
(1) Bei Bestattungen, Urnenbeisetzungen sowie Verlängerung der Nutzungsrechte die Personen, die nach bürgerlichem Recht und dem Bestattungsgesetz die Kosten zu tragen haben, der Antragsteller sowie diejenige Person, die sich zur Tragung der Kosten schriftlich verpflichtet hat. (2) Bei Umbettungen und Wiederbeisetzungen der Antragsteller. (3) Mehrere Gebührenschuldner haften als Gesamtschuldner.
§ 3 Entstehung der Ansprüche und Fälligkeit
Die Gebührenschuld entsteht bereits mit der Inanspruchnahme der Leistungen nach der Friedhofssatzung, bei antragsabhängigen Leistungen mit der Antragstellung. Die Gebühren werden innerhalb von 14 Tagen nach Bekanntgabe des Gebührenbescheides fällig; sie sind an die Verbandsgemeindekasse Bad Bergzabern zu entrichten.
§ 4 Stundung und Erlass von Gebühren
Zum Ausgleich unbilliger Härten können die in der Anlage bezeichneten Gebühren gestundet, ganz oder teilweise erlassen werden.
§ 5 Inkrafttreten
Diese Satzung tritt am Tage nach ihrer Veröffentlichung in Kraft. Gleichzeitig tritt die Friedhofsgebührensatzung vom 21.09.2021 außer Kraft.

I. Reihengrabstätten (§ 13 Friedhofssatzung)
Verleihung des Nutzungsrechts an Berechtigte nach § 2 Abs. 2 der Friedhofssatzung für 30 Jahre bzw. 15 Jahre

III. Bestattung auswärtiger Personen gem. § 2 Abs. 3 der Friedhofssatzung
Bei verstorbenen auswärtigen Personen, die gem. § 2 Abs. 3 der Friedhofssatzung kein Recht auf Beisetzung in einer Grabstätte auf dem Friedhof der Ortsgemeinde Barbelroth haben, wird näheres in einem Sondervertrag geregelt.
Ausnahmen hiervon können jedoch erteilt werden, wenn der/die Verstorbene zu Lebzeiten zu der Gemeinde Barbelroth besondere Bindungen z. B. früherer Wohnort o. ä. hatte. Über das Vorliegen dieser Voraussetzung entscheidet die Ortsgemeinde.
IV. Ausheben und Schließen der Gräber
Die Kosten für das Ausheben und Schließen der Gräber durch den Bauhof der Verbandsgemeinde werden entsprechend dem angefallenen Aufwand berechnet.
Sofern die Grabanfertigung durch eine Privatperson oder ein Privatunternehmen erfolgt, werden die Kosten entsprechend der zwischen der Gemeinde und diesem Unternehmen getroffenen Vereinbarung berechnet.
V. Zuschläge für Bestattungen
Grundsätzlich sind Bestattungstermine so festzulegen, dass die Arbeiten insbesondere zum Schließen der Gräber noch innerhalb der Regelarbeitszeit durchgeführt werden können. Für Arbeiten außerhalb der Regelarbeitszeit werden entsprechende Zuschläge berechnet.
VI. Ausgrabungen, Umbettungen sowie Grababräumungen
Ausgrabungen und Umbettungen von Leichen werden grundsätzlich von gewerblichen Unternehmen durchgeführt. Bei Abräumung von Grabstätten durch den Bauhof erfolgt die Berechnung nach Arbeitsumfang (Lohn- und Sachkosten).
VII. Verwaltungsgebühren
(1) An Verwaltungsgebühren werden erhoben für:

IX. Sonstige Gebühren
(1) Vorzeitige Rückgabe von Nutzungsrechten
Bei vorzeitiger Rückgabe des Nutzungsrechtes, vor Ablauf der Ruhefrist, an Wahl- bzw. Urnenwahlgrabstätten besteht kein Anspruch auf anteilige Rückerstattung der Grabnutzungsgebühr.

Sondervertragzwischen der Ortsgemeinde Barbelroth undals Antragsteller,
- 1. Der Antragsteller wünscht eine Bestattung auf dem Friedhof der Ortsgemeinde Barbelroth für
Name Vornamegeboren am verstorben amzuletzt wohnhaft in
- 2. Ein Rechtsanspruch nach § 2 Abs. 2 des Bestattungsgesetzes vom 04.03.1983 (GVBl. S. 69) oder aufgrund der geltenden Friedhofssatzung besteht nicht.
- 3. Die Ortsgemeinde erteilt die Zustimmung zur Bestattung auf dem Friedhof in der Grabstelle Feld. Reihe Nummer
- 4. Der Antragsteller entrichtet ein Entgelt in Höhe der jeweils gültigen Grabnutzungsgebühr + 100 % Aufschlag auf diese.
- 5. Im Übrigen gelten die Bestimmungen der Friedhofssatzung und der Friedhofsgebührensatzung entsprechend.
