Gebührenordnung aus Anlass einer Kasualie

Der Gemeindekirchenrat Sprotta hat in seiner Sitzung vom 12.06.2024 die nachstehende Gebührenordnung beschlossen:

§ 1

Gegenstand der Gebühren

(1) Für gottesdienstliches Handeln wird keine Gebühr erhoben. Verkündigendes und seelsorgerliches Handeln gehört zum unmittelbaren Auftrag der Kirchengemeinden in der Evangelischen Kirche in Mitteldeutschland und geschieht neben den allgemeinen Gottesdiensten auch bei Taufen, Trauungen, Beerdigungen oder ähnlichen Anlässen (Kasualien). (2) Für die Benutzung von Räumen oder Grundstücken bzw. bei der Inanspruchnahme von Leistungen der Kirchengemeinde aus Anlass einer Kasualie, durch die für die Kirchengemeinde zusätzliche Aufwendungen entstehen, werden Gebühren und Auslagen (Kosten) nach dieser Ordnung erhoben, soweit solche nicht bereits nach einer anderen Gebührenordnung erhoben worden sind. Gleiches gilt für Anlässe, die ohne Beteiligung der Kirchengemeinde in deren Räumen oder auf deren Grundstückenstattfinden. (3) Im Übrigen richtet sich die Nutzung nach den §§ 19 und 20 des Vermögensverwaltungs- und Aufsichtsgesetzes und den Nummern 19.1 und 20 der Vermögensverwaltungs- und Aufsichtsverordnung.

§ 2

Kostenschuldner

(1) Schuldner der Kosten ist:

a) wer eine Nutzung von Räumen oder Grundstücken mit oder ohne Beteiligung der Kirchengemeinde außerhalb der ortsüblichen Gottesdienstzeiten veranlasst,

b) oder für wen die Kirchengemeinde im Zusammenhang mit einer Kasualie oder Benutzung von Räumen und Grundstücken nach a) tätig wird.

(2) Für die Kostenschuld haftet in jedem Falle auch, wer sich gegenüber der Kirchengemeinde schriftlich zur Tragung der Kosten verpflichtet hat. (3) Mehrere Schuldner haften als Gesamtschuldner.

§ 3

Entstehung der Kostenschuld, Fälligkeit

(1) Die Kostenschuld entsteht mit der Beantragung der Kasualie, der Inanspruchnahme einer Leistung der Kirchengemeinde oder bei der Beantragung einer Benutzung von Räumen oder Grundstücken der Kirchengemeinde. (2) Die Kosten werden durch Bescheid erhoben und sind sofort nach Bekanntgabe des entsprechenden Bescheides fällig. (3) Die Kirchengemeinde kann die Benutzung von Räumen und Grundstücken oder die Inanspruchnahme von Leistungen verweigern, wenn erwartet werden muss, dass Kosten nicht entrichtet und entsprechende Sicherheiten auch nicht geleistet werden können

§ 4

Stundung, Erlass und Rückzahlung von Kosten

(1) Forderungen dürfen von der zuständigen Stelle nur gestundet, niedergeschlagen oder erlassen werden, wenn

1. 1. im Fall der Stundung die sofortige Einziehung mit erheblichen Härten für die zahlungspflichtige Person verbunden wurde und der Anspruch durch die Stundung nicht gefährdet wird,
2. 2. im Fall der Niederschlagung feststeht, dass die Einziehung keinen Erfolg haben wird, oder wenn die Kosten der Einziehung außer Verhältnis zur Höhe des Anspruchs stehen,
3. 3. im Fall des Erlasses die Einziehung nach Lage des einzelnen Falles für die zahlungspflichtige Person eine besondere Härte bedeuten wurde. Das Gleiche gilt für die Rückzahlung oder die Anrechnung von geleisteten Beträgen.

(2) Sind der Kirchengemeinde im Zusammenhang mit einer beantragten Kasualie oder Benutzung von Räumen und Grundstücken zusätzliche Aufwendungen entstanden, ohne dass die Kasualie stattfindet oder der Anlass wahrgenommen wird, so sind die entstandenen Aufwendungen in voller Höhe zu erstatten. Bereits gezahlte Kosten werden nicht, auch nicht teilweise, zurückgezahlt. Absatz 1 bleibt davon unberührt.

§ 5

Veranstaltungen ohne Beteiligung der Kirchengemeinde

Die Nutzung kirchlicher Räume oder Grundstücke bedarf in jedem Einzelfall einer Entscheidung des Gemeindekirchenrates. Ein Anspruch auf Nutzung entsteht durch diese Ordnung nicht. Die Nutzung wird insbesondere versagt, wenn sie im Widerspruch zur Widmung des Raumes oder des Grundstückes steht oder ein anderer Grund für einen Nutzungsausschluss nach Nummer 20 Vermögensverwaltungs- und Aufsichtsverordnung vorliegt.

§ 6

Rechtsbehelfe

(1) Gegen einen Bescheid der Kirchengemeinde auf Grund dieser Gebührenordnung ist der Widerspruch zulässig. Der Widerspruch ist bei der Kirchengemeinde einzulegen. (2) Kann dem Widerspruch nicht abgeholfen werden, so ist der Vorgang an das Kreiskirchenamt zur endgültigen Entscheidung weiter zu reichen. (3) Das Einlegen eines Widerspruchs hemmt nicht die Verpflichtung zur sofortigen Zahlung des Kostenbetrages.

§ 7

Kosten

(1) Für die Benutzung von Räumen oder Grundstücken außerhalb der ortsüblichen Gottesdienstzeiten wird eine pauschalisierte Nutzungsgebühr wie folgt erhoben:

a) für kirchliche Bestattungen und damit im Zusammenhang stehende Gedenkfeiern 0,00 €

b) für nichtkirchliche Bestattungen und damit im Zusammenhang stehende Gedenkfeiern 150,00 €

Mit der Gebühr sind die Verbrauchskosten und die Reinigung abgegolten.

(2) Leistungen von Dritten (Auslagen) sind nur zu erstatten, wenn entsprechende Kosten der Kirchengemeinde in Rechnung gestellt worden sind. (3) Der Gemeindekirchenrat kann bei anderen Veranstaltungen Mieten außerhalb dieser Ordnung vereinbaren.

Inkrafttreten

(1) Die Gebührenordnung tritt nach ihrer kirchenaufsichtlichen Genehmigung am ... in Kraft. Sie wird durch die Kirchengemeinde ortsüblich besteht gemacht. (2) Mit Inkrafttreten dieser Gebührenordnung treten alle bisherigen Kasualgebührenfestlegungen außer Kraft.
